Obtaining A Warrant

Incident Requirements:

  • The incident must have occurred within the city limits of Gardendale.
  • The offender must be over 18 years of age.
  • An incident report must be filed with the Gardendale Police Department.

Processing Time:

  • Allow 48 hours for the incident report to be processed. An investigator may be assigned and may refer the Complainant to schedule an appointment with the Municipal Court Magistrate.

Scheduling an Appointment:

  • Appointments with the Magistrate can be made by calling the Gardendale Municipal Court Magistrate at 205-631-7155.

Sworn Statement:

  • During the appointment, the Complainant will be placed under oath by the Magistrate and asked to provide a written, sworn statement.
  • If the Magistrate finds sufficient probable cause, a warrant of arrest will be issued. The Complainant must appear in court to give testimony.

Bond and Bail:

  • Defendants are permitted to make bond according to the approved bail/bond schedule.
