Open Burning Regulations

The Jefferson County Department of Health and Air Pollution Control Program is responsible for monitoring and issuing burn permits throughout the county. Fire departments, such as the Gardendale Fire Department, are tasked with enforcing the open burning policy within their respective coverage areas. It’s important to note that no open burning is allowed without a permit from the Jefferson County Health Department and Air Pollution Program.

Violating this regulation by burning without a permit can result in fines. Additionally, a No-Burn Ordinance is in effect from June 1st to October 1st each year due to the increased risk of fire hazards caused by dry heat and limited rainfall during the summer months. During this period, the county agency will not issue burn permits.

There are three types of fires that do not require a burn permit, though some may still need approval from the fire official with jurisdiction in the affected area:

  1. Campfires: No permit is required, but campfires are prohibited during the No Burn Season.
  2. Bonfires: While no permit is needed, the site and timing must be approved by the fire officials.
  3. Ceremonial Fires: Events like the Olympic Torch Ceremony do not require a permit.
